Welcome to Seen. These Terms & Conditions ("Terms") govern your access to and use of the Seen platform, including our website, web application, mobile applications, and APIs (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility & Accounts
You must be at least 18 years old and legally capable of entering into binding contracts to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. 2. The Service
Seen provides a conversational commerce platform that includes a shared team inbox, no-code automation flows, broadcast campaigns, analytics, and integrations with WhatsApp Business Cloud API and other Meta messaging products. We may update, modify, or discontinue features with reasonable notice.
3. Acceptable Use
You agree not to:
- Violate any applicable law, regulation, or Meta/WhatsApp policy.
- Send unsolicited messages, spam, or messages that infringe third-party rights.
- Attempt to reverse-engineer, decompile, or extract source code from the Service.
- Use the Service to transmit malware, phishing content, or illegal material.
- Impersonate any person or misrepresent your affiliation.
We reserve the right to suspend or terminate accounts that violate these rules.
4. Subscriptions & Billing
Paid plans are billed in advance on a monthly or annual basis. All fees are exclusive of applicable taxes unless stated otherwise. Subscriptions renew automatically unless cancelled before the renewal date. See our Refund & Return Policy for details on cancellations and refunds.
5. Data & Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of the content you upload; you grant Seen a limited licence to host, process, and display it solely to operate the Service.
6. Intellectual Property
The Service, including all software, design, text, and trademarks, is owned by Seen or its licensors and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without written permission.
7. Third-Party Services
The Service integrates with third-party providers such as Meta, WhatsApp, and payment processors. Your use of those services is subject to their own terms. Seen is not responsible for third-party outages or policy changes.
8. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, Seen disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, Seen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid to Seen in the twelve (12) months preceding the claim.
10. Termination
You may cancel your account at any time. We may suspend or terminate your access if you breach these Terms. Upon termination, your right to use the Service ceases immediately, but obligations that by their nature survive (such as payment obligations and indemnities) remain in force.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which Seen is registered, without regard to its conflict-of-law principles. Any dispute shall be resolved in the competent courts of that jurisdiction.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-product notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
